I am getting married to an Active Duty US Navy Sailor in March 2008. I am trying to relocate to Arizona in February. I am the mother of 2 children- 2 different fathers. (Divorced from both fathers).

Child A-
Child A's father has paid support on and off (more off than on... the state has to "hunt him down" every time he switches jobs). Child is 7 years old, ex has seen him maybe 6or 7 times since April of 2001 when we separated. Does not actively or regularly participate in child's life physically or emotionally. I have a recent email from him stating that he does not want to continue providing for my child. He was willing to cooperate with me and sign over his rights so he could get out of paying support, since then, he has learned of my plans to remarry/relocate and tells me he will get me for "parental kidnapping" if I leave the state. (I live in Illinois). He will not answer my phone calls or letters or emails. He has supervised visitation. I have sole custody. I got a default judgment when we divorced because he never showed up or filed anything with the court.

Child B-
Father disappeared when she was 10 months old, has not had contact with me or the child since October of 2004. There is a child support order but he does not pay. I have sole custody. He has regular visitation (but has not seen the child since Oct. 08, 2004). I got a default judgment for our divorce because he didn't show for the hearing. He knows nothing of my current plans to remarry/relocate. I have no idea where he is and even the state of Illinois can't seem to locate him.

WHAT can I do? I have no money for attorneys. I don't qualify for legal aid based on my income (grossing less than $33,000 per year for family of 3). What is my best course of action? FILING ABANDONMENT AGAINST THEM? AMMENDING VISITATION?

I'm at a loss here.

My fiance wants to adopt them both... but I know that is way down the road.
Also- I know the kids and I will be added to his military orders, so that we can be relocated with him when he transfers to his new duty station next August... will I still need Illinois Court permission to leave if my children and I are included under my husband's military orders?

You need to go to court to see if they will amend the visitation orders, but the way it stands now you can't move without the court's permission.

You can't force them to relinquish their rights. Father B you should be able to term on abandonment grounds, But A will be harder. Go after him hard for him back support, That may convince him to let go.

You really need a lawyer to help you navigate thru the courts.
