Copyright Infringement

I am seriously interested in re-issuing / reprinting a text which was originally published in 1890 or 1896 (it is difficult or impossible to get the exact date), my research on the topic is not clear - different sources cite different dates on when the first edition was printed. The author is deceased.

The publisher, in Germany, is apparently out of business. I could not find the publisher. I have tried to find out if the company has merged or been acquired by another publisher - to no avail. Apparently the last date when this publisher put out a book (this book ) was in 1976 to the best of my knowledge. I was not able to get a copy of this text and my understanding is that it is substantial different than the 1890-96 edition. It may be markedly different than the original edition.

In addition the text was edited, enlarged and reprinted over the years by different "editors".

After this lengthy introduction, my questions are 1.) how do I or ... 2.) do I need to obtain a release or transfer of copyright? . I checked with the United States Copyright office and I find it confusing. Who do I contact to get permission or clearance to reprint the text. Family ? Publisher ? Assuming the copyright is still in effect - 3.) what is my liability if I reissue the text?

I would appreciate any and all assistance.

Thanks

A. Solimene
