| US / Canada Statute of Limitations for Debt For over 20 years I had great credit in the US. Several years ago I moved to Canada and due to extenuating circumstances, early in 2004, found myself unable to pay on the three credit cards that I had (all US cards). As soon as I knew that I would not be able to make monthly payments, I contacted all three creditors, explained the situation and asked for some leeway until I recovered. One immediately raised my very low interest rate to almost 30% and the other two basically said, “Pay, or else”. Each time they would call, I would again explain the situation. In 2005, I was once again able to make payments and contacted all three numerous times to try to arrange a payment plan. All were extremely frustrating to deal with and none could seem to believe that I actually wanted to pay. I finally contacted over a half dozen lawyers in the US and Canada – all of whom said that it was an interesting situation but that they were unable to help, several credit counseling services in the US – who all said that they could not help since I was living in Canada, and finally a non-profit credit counseling agency in Canada. This agency was able to make a payment plan with two of the creditors who either reduced or erased the excessive interest and I am well on my way to having those paid off. The other has been unreasonable to deal with to the point that the credit counseling agency has said that they have never seen anything like it. I am now being passed around from collection agency to collection agency with the high interest mounting and demanding more for a monthly payment than I can pay. At this point, I am extremely frustrated and feel like I am getting nowhere with the one creditor (a large US credit card company). I’m happy to pay the two that I have been paying on and let this other one run the statute of limitations. Unfortunately, no one seems to be able to tell me what the statute of limitations is for a US citizen that is a Permanent Resident of Canada. I have never received anything in writing from this creditor or from any of the collection agencies, only phone calls during which I have not made any commitments. Can anyone help? Thank you. |
