You really did not give us enough info to give you good advice. Nothing about the nature, amount and age of the debt. No clue whether this is a real debt that you owe. No clue as to whether you can afford a settlement. So its real hard to answer.
Generally, you want to answer the summons with a notice of your Intent to Defend against the suit. You then send a copy of that answer to the plaintiff. In your cover letter to the plaintiff, you request verification of the debt and their right to collect it. If you believe its a valid debt, then you can add that, if they can prove the debt, you might be willing to discuss a settlement. |
