Judgment

I have been threatened with a judgment from a bad credit card debt. I did try to work out a payment plan but they wanted to take it directly from my checking each month and I did not want them to have my account number. I wanted to send a cashier's check.

I do not own my home and I am in commission sales so no steady income. I cannot afford an attorney. I do have some money in the bank but only enough to survive...rent, utilities, until sales pick up. I do have life insurance and am truly worth more dead than alive. Will they attach a judgment to that?

I need to know what to expect. I assume I will be served papers. If I do not obtain an attorney and do not show up in court, what will happen? Can they legally get access to my checking account?

ok, what they do is attach your bank account, if you have uncleared checks in the bank, to bad, they take the money, if your rent check your utilities check bounce they don't care, So if there is 400 but it is all out on checks, they still take the 400 and the checks bounce.

They they get a garnishment of your wages, normally around 25 percent of your pay. If enough is not left over to pay rent they don't care.

No they do not attach life insurnace.

But you need to show up in court and show them that in writing you have offered them a payment plan that they would not accept.
Make your offer to them in writing, They can't refuse a offer becaue you want to pay by cashiers check
