Collection Agenies

Can collections agency be nasty and mean to you? Can they call one a day, everyday? Can they call anytime they want, or their hours their allowed to call between?

What are collection companies allowed to do or not do? Can they threaten you?

Third Party (that is, a company other than the original creditor) Collection Agencies are under the Fair Debt Collections Practices Act (FDCPA). You do have a right to demand that they stop calling, but be careful about taking advantage of this right, as it often results in their taking further action.

A collection agency will lie to you, they will tell you that you can be put in jail, they will tell you that they are going to come and get your TV set and you couch. They may often call several times a day, every day.

They will "promice" to settle for a certain amount but not in writing, then when they get your check with its numbers on it, they will try to run though more money electronicly if possible.

They will tell you anything they can make up or think of.

Now they can also ( for real) take you to court to get a judgement and try to garnish you pay or attach your bank accounts.

The first few posters had some good idea.

I've notice in the past two weeks, it's become extremely quiet with no one calling me? Could this mean the collection agency is up to something?

Collection agencies must sent you a claim in the mail, you must answer this presentation within 30 days, or the debt is consider valid.

You must always answer and dispute the debt, demand verfication of the alleged debt. When you do this they must reply within 30 days.

Important!, when you send your letter, put in it, quote, " All contact will be done in writing", If they call after that they will be in violation of FDCPA.

I've been learning more about collection agenies, how are people so post to pay off debt, if they keep hiking up what you owe? At that rate you'll never be able to pay it off your debt. If you ask me not to contact you by a number that isn't yours, are they allowed to still contact you by that number? I've asked on several occasions for them not to use a specific number and their still using it. Can I file a complaint againist them? I know you can write a cease letter to stop contacting you, but can they still contact other people on your where abouts? I've been paying a small amount of money to this collection ageny, are they allowed to keep asking for more? I've also, been reading that there are other people with similar problem like mine, why isn't the state attorney general's office checking into these complaints.

They are scum, they will try to use anything they can to harass you. Make them prove their claim. In writing. File complaints, BBB, Attorney Genreal, FTC everyone, make them obey the rules.

Record their calls. If you catch them violating the FDCPA, they're in deep doo doo. From there you get them to pay the bill for you, and give you money on the side to settle out of court.
