garnishment of bank accounts from social security

I received a letter in regular mail, saying they(creditors of credit cards) were going to garnish my bank account and freeze it.....I only get social security and my husband get social sec. disabilty and 2 small pensions. can they do this??

I moved your post to the Bankruptcy and Debt forum (the forum Help area is marked as only for questions about using this site). Had you browsed this forum, you would have found an answer to your question. This advice is for future reference.

Before, they can attach your bank accounts, they need to obtain a judgement against you. However, once that happens they can get a writ against the account. While SSI payments are exempt from attachment, once thaey are comingled with other funds they are attachable. So you would be best setting up a specific account for exempt payments, then informing your bank that only exempt funds are deposited there and therefore its exempt from attachment. Regular social security and private pensions may not be exempt.
