Before, they can attach your bank accounts, they need to obtain a judgement against you. However, once that happens they can get a writ against the account. While SSI payments are exempt from attachment, once thaey are comingled with other funds they are attachable. So you would be best setting up a specific account for exempt payments, then informing your bank that only exempt funds are deposited there and therefore its exempt from attachment. Regular social security and private pensions may not be exempt. |
