    Protecting Social Security and Pension when in debt
    My husband and I are losing our home due to illness. He is 62 and receiving SSD benefits and I am 60 and receive a pension. This is the only income we have. I am currently working with creditors (owing 25K)to work out a payment plan however if they get a judgement against us can they attach his SSD and my pension (it is automatically deposited) legally in the state of Arizona?

    If you are losing your home anyway, talk with a bankruptcy attorney there may even be ways to save the home, you never know

    Hi caravanmom6,

    I can only speak from a UK point of view so it may not be the same in Arizona, but I cannot imagine that they would take the only income you have to live on, it is more likely to be any accetts that you have EG... house.. car... property... electrical goods , that type of thing to raise the money owed to the creditors.

    The fact that it has gone this far probably means you will have a judgement against you preventing you from getting any credit in the near future or until this is sorted out.

    They may suggest various options that will be open to you... sell your house and pay us off from the proceeds or sell some of your personal belongings to raise the money to pay us off...

    In any event they want their money, so they will do what is necessary to get it. However I don't think that they can take benefits or pensions that are paid to you direct... it is as you say your only income which they will realize,so will follow another coarse of action.

    I am so sorry for your situation but try not to worry, I'm sure they will do what is fair for you and your husband . The most important thing in all this ,is your health let everything else take care of it self, it will come right in the end I'm sure.
