| No written contract I signed up for service with this phone company over the phone. At the time, they didn't tell me upfront about a termination fee if I were to terminate my services within a year. Anyways, long story short. After 3 months of service I cancelled their service. I received a "final statement" in the mail. They had charged me for an extra month of service. When I called them up about it they told me to just pay the bill and I won't be getting any more statements. Being naive that I was I paid the bill. 2 months later I get a "revised final statement" asking me to pay a termination fee. When I called them up this time the rep who took my call said that the other rep that I talked to gave me bad information. I disputed this statement and I said I wasn't going to pay it. Apparently now they've turned my account over to some collection agency. Just last week some guy who claimed he is from the collection agency called me up asking me to pay the debt. I told him I was disputing the debt with the original creditor. He asked if I lived at so and so address and I said yes. But the thing is I just moved so I no longer live there. My question is am I still responsible for the alleged debt if the collection agency is unable to track me down to a permanent current address and phone number? And if they do manage to find me, can their claim be considered invalid because I never signed any written contract, eg. no contract/no claim defense? |
