My concern is that my husband at the time (divorced now). Set up a student loan account with Sallie Mae, a stafford government loan. I never co-signed for this loan and the divorce decree states that he is responsible for paying this debt. The problem is that I am getting harrassing phone calls and they are reporting to my credit bureaus! What I find unfair is that when I called representatives in regards to this account no information was given to me because of the fact that my name is not on the account (privacy laws). If I have no rights to specific information about the bill how can I be held liable for paying it then? Some lawyers say that even though I did not co-sign I am still responsible even with a decree if he refuses to pay and other lawyers say otherwise.

Debt incurred while married can be considered joint property just as income is.

But I would send a letter to the creditor telling them you are not responsible for this debt, that you never signed for it and that you will not pay it. Tell them any further correspondence from them must be only be mail.

I would then write to the credit bureaus telling them this is not your debt and to have it removed.

Ok now that's out of the way- Get Sallie Maes address and send them a Certified mailing with the following request: a Copy of the Promissary note, a do not call request in writing for your homephone (they should not be calling your cellphone it's against the law) and forward them a copy of the decree from the court showing that HE is responsible, and a request for them to update your credit bureau to reflect this-----it's always good to contact the Credit Bureau directly and inform them what's going on and that you want a listed statement on your report why this particular reporting is happening.
