Confused about statute of limitation in Ontario

HI.... I when bankrupt in sept/1996 and was discharged in june/1997 in Ontario Canada. my wife did co-sign for some of my debts(she was advised not to go bankrupt because she was in school on a student loan)......they did contact her till the year 2000.......they have not made any atempt to contact her since.... now in 2007 they have begun persuing her...... (its not on her credit report).

Is the statute of limitation passed or does it apply???

SOL was 6 years for debt prior to January 1, 2004.

Hello rocket:

From what my good northern friend says, it looks like the statute of limitations has run out. If that's so, then the collectors are going to be sorry when they show up in court. However, YOU have to make sure that the case gets that far.

The question you ask, "can they pursue her", isn't going to get you a satisfactory answer, because the short answer is, YES they can. If she gives up before the case gets to court, the question as to whether the statute of limitations applies or not, is moot.

However, if you were to ask, "can they win", my answer would be, only if you don't go to court.
