    Can I fight a Student Loan garnishment from 1983?
    I went to a technical college in the late 80's, the school has since closed down. While I was attending, I was asked by students if I needed a loan, I signed up for it then pulled out after my parents found out and said they would pay for my schooling. There were about five of us that got scammed by these students using our loan papers to get themselves loans. I never saw the check, I was never able to use the education, and have been fighting this for the past 25 years. The original loan was 2,500, they are garnishing my wages for 8,000. I don't know how to fight it anymore. What do I do?

    Unless you can prove that you didn't sign for or get the money, you are stuck paying for it.

    Did you file a police report as soon as you learned of the scam? Have they obtained a judgement against you?

    My signature is on the loan paper, but there isn't proof of the check. Up until 3 months ago, I had collectors calling and offering me lower total amounts of the loan if I paid within 2 weeks. The Dept. of EDU said if I can prove that the school was closed or that I didn't get anything from it, I could try going to court. While I was doing this I got the garnishment.

    The garnishment should list details of the court order. You can then go back to that court to vacate the garnishment on the grounds that this was a case of fraud.

    YOU need to speak to an attorney.

    YOU can't fight the government on your own, at least not successfully.

    A good attorney will put an end to this quickly, if things are as you have stated.
