Bankruptcy and Motion for Sumary Judgment

I received a motion for sumary judgment jan14. if I file for chapter 13 how long before they can
get a judgment? And If they do will 13 wipe it out? I want to know if I have 30 days. Will I receive any other notice from them about the motion?

As soon as you actually do file bankruptcy and get a case number, notify the other attorney who is going to get the judgment against you as you filed bankruptcy. This will stop any action against you. Be sure to tell your bankruptcy attorney of of your debts (and especially this one).

If you file Chapter 13 or 7, there is an automatic stay which stops all collection activities by your creditors. The creditors must have notice of the bankruptcy filing; you can call and/or FAX each creditor once you have the case number. The claim will then be paid or discharged in your bankruptcy case.
