Bankruptcy in FL

I have some questions about Bankruptcy. I see in Chapter 13 you keep your possessions because you are repaying your debt. Has anyone here filed for Bankruptcy here in FL. Can you give advice. Then also is an insurance company considered a creditor - will my bankruptcy be reported to them. I contemplating Bankruptcy and meetiing with a Lawyer. After several trials and tribulations due both hurricanes and other factors I am considering Chapter 13. I hate the thought of it. I was on a Credit Counseling Program when I moved here and was doing great. Then after the 2 hurricanes I begged relief from my payments for 3 months. I called back to have them re-instated, they were going to do so as far as I knew....but then they dropped me. Around the same time my son went into Intensive Care (he's fine now) but I missed the drop letter, I just assumed they were going to start it back up. I didn't find out until about 2 months later. So due to everything I fell way behind in payments. Some companies have been willing to work with me but now I have these damn Junk Debt Buyers that won't set up a payment plan with me to repay the debt so I have no choice. Either way the debt stays on my record as a charge off and I get to pay garnished wages....The junk Debt Buyers have given me no choice.
Will my car insurance company be notified. Has anyone worked with Triad and filed Bankruptcy will they let me keep my car?

Hey Jennifer, those questions are best asked of an atty but no harm in asking here, just rely only on an atty's advice, about your car ins company being sent your credit report, I work for one and we dont ck credit, some companies do, and by the way, your credit is reported on one or all of about 3 or 4 credit companies that are nationwide. Now if the car ins co cks your credit they can either decline to provide you coverage or increase your premium. Hope this little bit of info helps.

unless your insurnace company is a debtor they are not notified, they are free to check your credit, and many do, but others don't.
And most don't rate you up if you are already insurned with them.
Some use credit history in underwriting new insurnace, since many people who file bankruptcy have been known to do insurnace fraud, not all, not most but some

But yes you should be able to keep your car and other property.

Your attorney will help you, you will need a list of every, and I mean every person you owe money to, thier address, the account number and the current amount owed.

Now a chapter 13 also has items that will have to be paid, secured at a high value than unsecured. So you will have to have income to pay the chapter 13.

I'd love to make a hard learned suggestion. Once you file, your credit score will TANK. Auto Insurance weighs heavily on score fator for risk assessment. Be sure you keep in good standing with your auto policy. If you go else where and your score is below 620 - 650, your going to PAY PAY PAY. Also, be sure to keep "one" credit card with a decent balance. You can't live without a CC these days. If you apply for a CC after bankruptcy, you'll PAY PAY PAY as well.
