I had a loan with BMWNA (car loan) back in 2002, while I was Deployed to Iraq my now ex-wife did not pay on the car first missed payment aug 03 and the car was repo'ed in Oct 03.

As of my most recent credit report Oct 09 the charge off is there but no Judgement. Since the contract was signed by me in Colorado, and the CO Statue of Limitations is 6 years, my question is:

Can the original creditor which has the acct listed as CHARGE OFF, file for judgement?
