Someone please give me some insight! In 2005 my wife and kids were returning home from California during a bad winter storm and was involved in a hit and run, in fact the guy who hit my wife and kids left them. Thankfully my family was okay, but the car was totaled. My insurance company paid what they felt the value of the vehicle was. Leaving a sum of just over $5,000 left due. According to the insurance they paid the company what was due and it was done. Here it is a year and half later and the auto company HSBC is saying they charged off the end balance and that I must pay this to them to avoid further action. When I asked what the actions would be the reply was I would need to go to the internet to see what they could do to me and my wife. I am not sure where to go or what my rights are. Can anyone give me a direction to head in. I understand each state is different, I live in New Mexico.
