frozen bank acct

i had my bank acct frozen.........from a old credit card bill ...that i forgot about because ive been moving around the country.....i havent got a bill in probley about 5 years........i have agreed to pay 200.00 a month...but did not sign the papers yet..can i go bankrupt still........ i cant afford 200.00 a month it will leave me homeless..i think the bill was only about 1,500.00 and they want me to pay almost 4.000.00..................please help me i dont know what to do

have you read thru the threads here? There are procedures you can use that may get you out of this. You can file a motion to vacate the judgement, forcing them to show proof of the debt.

I would browse thru the threads in this and the Bankruptcy and Debt forums where you'll find a lot of info to help.

I agree with scottgem File a motion to vacate the judgement and make them prove you owe the debt If you owe it and they can prove it , you might need to seek the advice of a bankruptcy attorney

excon agrees: Here's a greenie, but I disagree. You assume that because he files a motion to vacate, that it will be granted. From my experience, I seriously doubt that it will.
