Hi AtlantaTaxExpert! We are filing a state tax return in New York but still awaiting for my ITIN. We have a refund. I checked the NY website it says there that we shoud file an extension eventhough we dont owe any tax. Since we were not able to apply for an extension before the filing due date, will there be any penalties? Should we still file for an extension even if it is already April 18? Thankyou very much!

If no state taxes are owed, there are NO penalties for filing late.

You can file as late as 15 April 2010 and still get your refund with no late-filing penalty.
