My two roommates and I re-signed our year lease(to begin in August after our current lease expires)about 1 month ago. One week ago one roommate went out and bought a house(not the first irresponsible move he has made), and thinks he is entitled to a subleaser. In our city, at least 2 of three people in our house must be related(to keep college kids out). So am I correct in assuming that he needs to find a subleaser related to either myself or the other remaining roommate? My remaining roommate and I do not want to live with one of his irresponsible friends, nor any strangers, so can we legally reject his subleasing options, or is that typically just an etiquette move and the only legal approval must be received by the landlord? BTW, landlord must approve subleaser according to specifics of lease. She told us he would have to find someone related to us or provide his share of rent anyway, but are there any other loopholes that he can utilize to escape his portion of the lease? We realize we(us remaining roommates) may have to take him to court to get that rent since we would be responsible if he bails out. Landlord also gave us the option of subleasing the whole house out(if decision is unanymous)confused, doing all the background and credit checks, advertising, finding related tenants, and collecting rent, but remaining roommate and I refuse because we do not want to be responsible for rent for two dwellings should subleasers bail out. Any advice would be very appreciated!:confused:
