Hi,

I am on H-1b full time at a small company. I got My paycheck with no tax holding from my boss and got W2 at end of the year. The problem is that company does not give me 2006 W2, but wants me to file 1099. I know 1099 is problem for my H-1b and GC, but I do not know what I am going to do or how to deal with the employer to get my 2006 W2. Please help…

You are correct; you SHOULD be getting a W-2.

But if your employer does not want to cooperate, you have little choice but to fle your return with teh Form 1099-MISC, which will require a Schedule C and probably a Schedule SE.
