My cousin was sentenced to 1 year in jail due to a gun charges but it was self defense . A group of girls came to her house trying to jump on her so she went and got a gun and shot it in the air and also this is her first offense what should we do

Get an attorney. A good one.

**EDIT** I see that she was already sentenced, so she's been to court and convicted.

What should you do? Visit her.

Can her time be dismissed? Possibly if her attorney files an appeal.

You do realize that even though she fired the gun in the air, that someone could have gotten killed, right?

Anyone could have gotten killed by the falling bullet, not just the girls that came to her house.

They have no evidence? If they have no evidence, how did she get convicted?

Even though discharging a firearm this way is illegal, I still feel there is more to this story that we are not hearing. If it really happened exactly as the OP suggested, then I can't imagine jail time of a year. I think something is missing.

J9 nailed it. She's been convicted and accepted her guilt. If anything, get a lawyer and file an appeal.

If she just got one year, then most likely they only convicted her of a minor part of this. The issue is, if she could "got and get a gun" then she could have went and called the police. Or she could have went and locked herself in a room. Getting a gun, was the last thing she should have done, if she could have gotten away, without using any violence at all.

A gun, steps things up to a deadly issue

Did she agree to a plea bargain ? If so, she can not appeal.

If she had a trial and was convicted, there there was plenty of evidence, the other girls as witness, most likely the gun
