View Full Version : Mother of 2 month old won't let father see baby.

Illinois, father signed a form at the hospital and name is on birth certificate. Mother of baby attacked the dad and kicked and punched him so he left HIS house, and now she said he can't come back. The dad doesn't want to go cause more issues, there are2other little kids in the house,he is worried the mom will throw stuff or something, they are not married, he just wants to see his daughter.

He goes to court and files for visitation.

Or, depending on where he is, he should consider obtaining a domestic violence restraining order.

He's apparently in Illinois - I wondering why, with children in danger, the OP is posting on AMHD and not at the Police Station.

If this is his house, then he should be able to evict her. But the bottom line is he needs to go to court to establish visitation and who gets to stay in the house.

I'd file first with the Police and then ask for emergency intervention by the Court.

I agree with the others. First, go to the police and begin proceedings to evict her from the home. If it is your house, she cannot evict you and if she cannot live with you, she has to leave, not you.

Second, see a family law attorney and begin proceedings in court to establish a parenting agreement with the child's mother including custodial arrangements and financial support arrangements. As you are established as the child's father, you have equal rights to the child but for that to mean anything, you need to work through the courts to enforce those rights.

I see no reason you should move out of a home of which you have sole ownership. It speaks well of you that you would rather leave than risk a physical altercation, however.
