Can my husband adopt my two kids? I was sexually abused by the father of my children I was 15 when all this happened I was abducted by this man 20 years older than me. Consequence of this had two children now 9 and 9 with 10 months apart . He is originally from El Salvador when he was arrested the judge gave sentence to him. Which I really not remenber what it was. But came under bail and was deported shortly due to the same case.. now I have 25 years and married my husband and I have a business and live very economically stable. Can he adopt my kids?? I did not hear of the man who abused me. Eight years have passed since he was deported. When I was giving birth to my first child he change my name at the hospital so the police did not arrest him at that time. So with my other son he did the samething . Now I could correct my name on the birth certificate of my children. I do not no lawyer who can help me with this. My two children have the last name of this man and I would like to correct this. I hope someone help me with some information on lawyers in my area to correct the birth certificates of my children. I currently resident live in marietta ga. Thank you and God bless

YOU need to hire a lawyer... because you aren't going to go through the expensive and complicated adoption process without one...

All of what you want to do are possible... but they aren't simple or easy. You need the help of a professional familiar with everything.

The answer is yes he can adopt and the courts are likely to grant the adoption. But you are going to need an attorney to prepare the petition properly. Any Family Law attorney should be able to handle it. But you need to present to the court proof that you were underage and sexually abused. This means getting the right court records to present as part of the petition.

Also at the time of the adoption you can apply for a name change for the children and have it granted when the adoption clears. My only question here is how come you haven't fixed your name as it appears on the birth certificates? This may cause you huge problems and require you to take a DNA test before any type of adoption can take place.

Since there is court documentation of the kidnapping and rape, and he has left the country, this can likely be done without too much difficulty but it is somewhat complicated because you'll have to find the old court records to prove what the father of the children did to you.

Actually, proof of what happened in the criminal case is probably not necessary. What you would need to prove is that the father has had no meaningful contact with the children and doesn't pay child support (I believe it's called "child abandonment" in Georgia.). Was child support ordered?
