View Full Version : Ex Fiancé took my truck it is my livelyhood but in her name can I get it back?

My ex fiancé took a truck. My trade is home repair and remodeling and my tools and some supplies were in the truck. The truck had been put in her name to keep rate down on truck. I was once told by a police officer that she could not take it because it will bankrupt me due to of my trade and the fact that I drive it everyday. Is this true and what can I do? I am in Michigan. We had an agreement on the truck and our home. Rather than split the car, house and utilities she would pay the truck and I would pay rent and utilities. I have kept up my end of the bargain and paid rent and utilities although the lease is in both of our names and now she has the truck too. What can I do?

If the truck is in her name its her truck not yours. However, she can't keep your tools and personal stuff that was in the truck. Now if the truck has your business name on it, you might have a case against her.

You could probably sue for dissolution of a de facto business partnership. Ask that the assets and liablilities of such partnership be either sold (and the net proceeds divided between you) or equitably divided.

It's going to be messy and, of course, you should have an attorney for this.

Short term,
Buy another truck and tools and keep working

Long term, sue for value of tools.

The truck is in her name, you were trying to cheat the insurance company as to who was using the truck and who owned it, and to be honest this is what happens.

legally the truck is hers and there is nothing you can do
