how many dependents may i claim , over the amount that actually live in my house and still be able to get a return. legally

Hello watcher:

It doesn't matter whether they live with you or not. What matters is that you contribute more than 50% of their support. So, how many ever you support, that's the amount you can claim

If you are speaking about the W-4, claim yourself, your wife and your children, plus up to TWO more.
