Hello,

I entered US on 24th June 2006 in H1B visa and till now staying in US. I am not sure which forms to be filled for federal and state tax. I stayed in MA state right from day1 till now.

Question.
1. Whether i am a resident or non-resident aliens.
2. For MA state tax, there are 2 forms forms1 and forms1-NR/PY. I dont know whether i should fill forms 1 and forms 1-NR/PY. It was mentioned in the instructions that if you stayed for more than 183 days and somemore conditions, which i am not at all clear. As per my conditions i stayed in MA for 191 days starting from 24th Jun 2006 to 31st Dec 2006. Please help me out in deciding whether i should file Forms1 or Forms1-Nr/PY forms.

3. In case of federal, whether i should fill 1040, 1040EZ or 1040NR

Thanks in advance

1 & 3) You need to file a dual-status return, which requires submission of BOTH Form 1040 and 1040NR.

2) File Form 1-NR/PY.
