Hi,

I moved from India to NY state in Feb 2006 on a J1 temporary non immigrant visa. I filed 1040EZ for the federal returns (I was an F1 student from Aug 2000 to Oct 2005). My question is

1) Am in a non-resident or part year resident for NY state for the year 2006? As far as I understand, I am not domiciled in NY (my permanent home is my parents house in India), but I have leased an apartment building which is part of the university provided housing in New York city.
2) What are the forms I need to fill for filing my state returns?
3) Depending on my filing status, do I owe city taxes as well?

1) Since you are a student, you are considered a non-resident for tax purposes.

2) Form IT-203.

3) Not sure, but I do not think you are considered a city resident because of your student status. Call the city tax department to be sure.
