My brother and my boy friend are in custody for entering a motor vehicle,possesion of tools for commission of a crime and loitering,But they have my brother on camera actually breaking in peoples tool boxes, an my boyfriend was pawning the items my brother had stolen,about how much time is my boyfriend looking at being that he was on probation for a burgulary from 2006,thats all he has on his recored,now my brother just got out of a county camp back in june an he is on resiterist probation .

Are they going to drop the charges ? or was this part of a plea deal he was working on.

If he does not get it dropped, I would say he will get 3 to 5 years with maybe 1 to 2 to serve.

the issue is what he was on probation for, and his prior issues of being revoked. What ever time his sentence was for that, you can almost expect him to serve that full sentence

Well he's going back in for the probation violation..............PLUS whatever they give him on the new charges, and odds are he will be convicted...your boyfriend will likely be too for at a minimum being an accomplice.

The court determines what you end up getting...but FrChuck has enough experience to make pretty good guesses on what that will be.

my boyfriend said that my brother applied for a public defender so their giving him a paid attorney what is that all about and do you think he will do any good?
