Mostly its going to depend on the circumstances around the case you have and how the courts decide on it. You will have to file for a custody change in court. Fr_Chuck Jul 17, 2012, 02:30 PM Which parent is the child living with, the one that moved out of state or the other. nikkitonya Jul 17, 2012, 02:40 PM My wife and i have joint custody she want to move out of state and remarry.we have three children do she have the right to take them. ScottGem Jul 17, 2012, 04:45 PM First its not a good idea to piggyback your question on another thread. This can lead to confusion. So I've moved your question to its own thread. If you have joint custody and visitation, no she doesn't have the right to just move with your child. She has to get your permission and/or a court's. She can move but not with the child. ANY question on law needs to include your general locale as laws vary by area. {Mod note: Threads merged} Copyright ©2005-, Ask Me Help Desk
