My husband of 6 years has a 13 year old daughter that he had been taking care of since she was a baby. Before we were married and were living together, I helped take care of her. I've been taking care of this girl for about 10 years now. 5 years ago, my husband was awarded primary custody of his daughter. Years prior, the mother had primary custody and was receiving child support from my husband. She lives in California and would only keep the child for a few months at a time before deciding it's too much for her and send the child back to us to take care of. We happily accepted, but my husband was still paying child support while taking care of his daughter. When my husband was given primary custody, he never received any child support payments from the mother. Now the child wants to move to California to live with her mother, so we agreed. If the custody papers are modified to grant the mother primary custody, but also mention that there will be no child support due, can the mother still ask for and be granted child support? Moreover, if my husband remains unemployed, will money be deducted from my pay and make me liable for child support payments? How can I avoid this?
