View Full Version : Can I get my security deposit back if my landlord hide some stuff prior to moving?

I found an apartment which to be available in a week. Landlord said there is one available without washer and dryer, but if I want to wait 1 week then that unit has washer and dryer. So I gave the deposit of $300, but when I looked at the apartment in 1 week I saw that that unit has no washer and dryer inside my unit but I had to go to a different room outside to use washer and dryer and on top of that I have to pay to use washer and dryer and this is something I was not told before I gave deposit. Because of that I don't want to move in to that apartment and want to get my security deposit back by opening Small Claim against. Any advices?

If the apartment does not have the amenities listed in the lease or agreed upon IN WRITING, then you have a case. If its not in writing but you think you can prove that it was promised you may win your case.

Agree, if the lease you signed, or the paper work with the deposit listed items that is not there, you may get out of it.

If you failed to inspect the apartment prior to paying, you are normally out of luck
