There was an existing "chain-link" fence [I purchased/installed] on the property line. Then, years later, I decided to purhase a lattic-wooden fence. The new fence was place in front of the chain-line fence [two fences erected]. As time went by I had not noticed the people on the block behind my property had removed the chain-link fence [since it was lower then the wooden fence] and had paved and started using their backyard privileges all the way up to the wooden fence. They then started erecting lights/sun umbrellas on the wooden poles without permission. I have thought about having the land surveyed again [not sure how costly this would be] and having the wooden fence taken down and a rod-iron fence erected... To do this, would I have to go to court since the chain-link is missing [can't prove they took it down] and where would the law state property line markers could be placed? Placing markers would go right over the top of two vehicles they have started parking abuting the wooden fence. These people are renters and the owner of the property, which I have tried to communicate with, could care less what they have done/do! Please advise... and thanks for listening... Send a letter to owner (certified) with a copy to the tenants, that your property line extends x inches beyond the existing fence. Therefore, any permanent fixtures that are on your property need to be removed ASAP. If they are not removed by x date (give them 2 weeks) then you will have them removed and bill them for the costs. You would bill the owner, not the tenants. He would have to then sue his tenants for reimbursement.
