I was recently served with a complaint & summons for sprecial civil court. My son's father is suing me for a serioes of checks he gave me in 2005 & 2006 he is now claiming are loans. He did loan me money not as much as hes claiming when I was pregnant duing that time and I paid him back. He says I owe $4100.00 with atty fees and court costs. I borrowed $1100 and paid that back. he wrote loan on the check memo after I cashed the checks. This all came about when I tried to modify the visitiation schedule this year in family court. he never mentioned the "loan" before that. Do I have a defense. As I understand it since I made payments in 2007 & one in 2008 the Statute of limitions was stalled.

Should I try and fight this? My credit ruined from going back to school, I already have judgments but its the principal. I dont owe him anything. I cant pay my bills each month as it is and I recieve NO child support we split everything 50-50. Hes got a great attorney if I go by myself, I WILL lose.
