On probation for dv, with condition refrain from possessing a firearm, destructive device, or other dangerous weapon;

Can this person knowingly go where the are loaded accessible weapons and shooting going on.

Would this be considered a violation?

To ME possessing is having it his hands. To ME being around others while they're shooting wouldn't be a violation... But, I don't believe a probation officer would agree with me, and I believe they WOULD violate him.

Could he beat it?? Maybe, but he'll be in jail waiting for the hearing. It's probably best to avoid those kinds of situations altogether.

You can confirm this with your PO, but if you have access to one at all it is a violation.

I had a close family member, had a old single shot shotgun on the wall, it was an antique and was so rusted it would not open and would most likely blow up if you tried to shoot it.
It was turned over to the Feds, and the convicted him of possession of a fire arm by a convicted felon, he is serving 10 years for a old rusted gun hanging on the wall at his girl friends home
