My spouse arrived in Jan 2007. Whats the procedure to get TIN for my spouse and is she eligible for dependent status on 2006 returns. If she is going to get SSN later this year, do I still need to get TIN for her this year.

My status is H1 right from the beginning and my wifes status is H4.

If you were H-1 anytime in 2006, you can file jointly with your wife and BOTH choose to be treated as resident aliens (your wife physical location in 2006 is irrelevent). However, by doing so, ALL of BOTH spouse's worldwide income become subject to U.S. taxes.

But we got married in Jan 2007 and my wife first arrival to US is Jan 2007 only.

You did not SAY you got married in 2007; you simply said she ARRIVED in 2007.

If you were not married on 31 Dec 2006, then you must file a Form 1040NR-EZ if you were not in the U.S. for all of 2006.

If you WERE in the U.S. for 2006, then file as a resident alien, probably filing Form 1040EZ.

I am Married on Jan 28 2007, My wife came here on FEB 28 2007, i need to apply TIN for her, can any one suggest me the process

You must wait until next year, then apply for her ITIN whe you file your tax return.
