Can you define for us what you mean by early and why you have a problem with it?

It depends on the terms of the visitation order. But generally, taking a child out of school would not be in the child's best interest.

Can they, most likely if it is after the time frame where the non custody parent has their visit. But they should not do it except on extreme need. Special trips or needs of the child. Just as the custody parent will check the child out early there can be reasons for the non custody parent to do it also.

With that said, if they continue to do so, you will have to go back to court to get specific terms in the order.
