I was convicted of 3rd degree aggravated assault with a deadly weapon in late 2003, and released from jail in june 2004. My fiancˇ and I are thinking of relocating to Australia. I see that you say whether or not they accept you is if your crime was punishable by 12 months or more. Now my question is, do they go by whether the crime is actually punishable by 12 months, or do they go off of the sentence? My charge is definitely punishable by more than a year in some cases, but I was only sentenced 10 months, with no probation. Also it is almost 8 years later now, with no trouble with the law since. Can anyone explain this to me?
