Hello,

I came to US on H1B visa in April 2006. I was in US till OCt and went to my home country for 2 months and came back to US in Jan 2007. Which tax form should I use? Am I eligible to use form 1040 since I was in US for min. 183 days in 2006? Please advice. Your help is appreciated.

You need to file as a dual-status alien. You will file Form 1040 and attach a statement which says you have no U.S.-based income while you were a non-resident alien.

You cannot claim the Standard Deduction.
