8 years ago upon our request the city vacated a 25 foot wide 190 foot rightawy. The property is abutting another subdivision. When the property appraiser came out to inspect the property and place the assessment he informed us at that time that we would receive the entire 25 foot piece as it was originally dedicated from only this subdivision and plat.
After receiving this news we fenced,concreted and laid asphault on this entire strip as we run a small business at our house. The abutting property was sold 2 years ago. The new owners decided last month that they want what they deem to be their 12.5 foot piece.When reading the city ordinance it reads (The property will be conveyed by operation of law to the adjacent respective property owners). Now we have paid taxes for over 7 years on this piece of property and the tax collector still asserts that the property is ours. The new owners however went to the previous owner and got a quite claim deed
Signed over to them for the 12.5 foot piece. The neighbor went so far as to hire a survey company to come into a locked area and spray paint an orange strip down the middle of our blacktop. I complained to the city and to the county surveyors office. My question is has anyone ever heard of similar situation and what was the outcome? He has had a lawyer send us a threatening letter to remove our 8 year fence but we aren't budging until a judge says we have to. The old neighbor never said a word when we put the 6 foot fence up.
