I have been living with this girl since 3 months. I was never on the lease and I paid her deposit with my first month's rent. (I mentioned it on the check). On the first of May, I verbally told her that I will be moving out at the end of May. She said it's fine but the next day started acting all grouchy. She sent me a message asking me to confirm that I will pay her the deposit. I texted her that I will. I forgot to give her the check that very day and next day she sent me a text asking me to leave the check on a table. I didn't get to look at the text till later when I emailed her asking that it's redundant to write her a check when she will have to write it back to me at the end of the month.. at the end I emailed her saying that I will give her the deposit but if she agrees to give it back to me when I leave at the end of the month.. she replied, Sounds good.

I am not too sure if she will give it back to me. If she doesn't, will I be able to pursue and get it back?

Thanks! I really appreciate anyone's help on the issue.

What deposit? She requested a security deposit as part of your tenancy? If you gave her a deposit, then why do you have to give another? She has to return the deposit to you after you move out.

This is very confusing.

We adjusted the first deposit for the last month, May. She is now asking for me to maintain that deposit even when I am moving out at the end of May and though I am moving out in like 20 days..

I'm sorry but you aren't making much sense. A deposit is kept until the tenant vacates and then is returned less and damages or amounts owed. Maybe he initially agree to apply the deposit towards the last months rent and changed her mind. But you owe the May rent.
