Are you saying:

If that IS what you are trying to say, then if a DNA test has determined paternity, then yes, they should be paying support.

If he is not legally established as a father then he is not obligated by law to pay child support.

Well they are in state New Jersey and he live in westchester and he not deniying that child might be his but matter of this is that she gave his name a boom he the father with out them having dna on file stating he fatherchild does not have his last name nore like I said his name not on birth certificate

First, please try to type in regular intelligible sentences which include punctuation. It is very hard to understand what you are asking.

Child support can ONLY be required by a court. The mother will have to go to court to get an order for support payments. If the alleged father claims he is not the father, the court will order that a paternity test be done to determine paternity. They will not issue a support order based solely on the mother's statement that he is the father.

If you are receiving Supplemental Security Income (SSI), the federal government does not allow these benefits to be garnished.

On the other hand, Social Security Disability Insurance (SSDI) can be garnished to pay child support payments. SSDI benefits are funded from the money you as a worker paid into the Social Security system (through employment taxes) when you were still working. The amount of SSDI benefits you get is based on how much you earned/how much you contributed into the Social Security system (via taxes). When employees become disabled and are unable to work, these SSDI payments act as a replacement of income. According to the federal government, because SSDI is considered a substitute for lost wages, it can be garnished for child support payments.
