View Full Version : What is the statue of limitations for the age of collecting child support

I applied for child support in the IL for my son when he was 7. His father lives in LA. I provided all the information I knew about him including place of employment, parent's & syblings, city where he live, etc. The only thing I didn't have was his S.S.#. My son just turned 21 a few weeks ago. His father never provided anything for him,and is married with other son's. My son recenlty moved to LA, and meet his 1/2 brothers (his only syblings. H I was wandering, not for myself, but could my son apply for any type of back child support?

First, why was this posted in Relationships? This is so clearly a Family Law issue.

Second, what happened to the case in IL? Was support ever awarded? I understand nothing has been collected, but what is important is whether a support order was ever issued.

And to answer your question outright. No your son isn't entitled to anything. Child support is for the child and is paid to the custodial parent. If you're the parent that would be you. What you do with the funds is also up to you.

And to answer the first question, regarding the SOL, again it would depend upon whether a support order was ever entered. If not, retroactive CS is not awarded in most states,so you would be out of luck. If an order already has been entered, a SOL would not be a problem.

Yes, if and when you filed, in IL, did they issue a court order for child support, or did it never get to court ?
That will be the first issue we need addressed, to see if YOU can still go after him.

The son can not do anything, it is you, not son that has the right to sue for the money

Thanks. Your reply was helpful. I had two separate appointments at the child support office in Chicago, IL. I filled out all the required paper work with as much detailed information on the father that I knew of. I lost two days of work at the time. I did not get any further response for child support since. I don't know if my paper work "go lost" or even if a support order was issued. I didn't hear anything on it.

Is there anyway possible that this case could be reopened?

Even though my son is now 21, and I am the custodial parent, could I possibly get this case reopened and still go after the father for child support?

First, please use the Answer options for follow-up questions or info, Not comments you do not need to reply the same to each response.

So what you need to do is follow-up on what you did and see what happened to it. But if nothing was ever filed you may be out of luck.
