You have to get a lawyer and file in court. They can also award you child support.

Please pay more attention to posting guidelines. There is a Read First sticky in the Children forum (where this was moved from) that directs questions of a legal nature to this forum.

One of the reasons for doing so is that there are often sticky notes at the top of certain forums that answer frequently Asked questions. One of those stickies deals with abandonment.

You cannot file abandonment against him. What is it you really want? Do you want a step father to adopt your child? Do you want to find him and get child support? Do you just want to end his involvement? Abandonment may be used as a means to get those things, but you don't file for abandonment. So please explain what it is you want to accomplish so we can help.

Then file for a legal name change. The court will require that you make a good faith effort to contact him. Once you satisify that requirement the change will probably be granted.

I tried to file a legal name change.where I went the clerk told me that I needed to have the farther there. I told her that I didn't know where he was at. She told me that the juge wouldn't be able to do anything for me.

I know I'm required to give him legal noticeand if he can not be found, the court must appoint an attorney for him.if that attorney do a thing call pudlication.then the juge will let me change her last name.the thing is I don't know how to start.I do have the petition to change the name.I also have my notary papers fild out.it's just when I went to get a case number they did't let me get one.so what did I do wrong?

I think you mean publication. This is where you pay for a legal notice in the newspaper informing him of the action you plan to take. This is what I meant by making a good faith effort.

I would suggest you consult an attorney in your area for the exact rules. You can also try a local law school, many have free clinics staffed by students who can help you prepare the petition properly.
