View Full Version : What do I need to file for child support and custody of my son

My son has 2 years old and has been living with me for over a year now and his mother promises to come get him to spend some time with her and every time she has an excuse such as, I quote "Ican't handle him in the summer I would get him in the winter", which does not make any sense at all. My mom and dad has been supporting us when I wasn't working. I am now working and I am trying to support us and still trying to help out with a bill or two because I live with my parents. They have been really good to us, "God bless them". I called her for the first time to ask her for some help with things that he needs and she threatens that she is coming to get him. She does this every time. When she had him when he was a baby, although I would send her money she would still call and ask for more money and I would still send it. She is not ready to be a mom, and I want the best for my son please advise me. Thank You!

The legal advice - if that is what you are asking for - is to take this to Court. Ask for a custody order and ask for support. You may have to prove that she is disinterested or unfit to parent the child.

Has any court issued any order concerning custody or support? Have you been legally acknowledged as the father? Are you on the birth certificate?

If you want to establish custody and be the primary custodian then you need to provide proof that the mother has given care over to you for the past year and you petition the court to name you primary custodian and establish a support order.
