Ok My 2 nephews are living with their step dad. My sister their mother died this year their real daddy died the year before. The step dad has legal gardianship of the boys they are 14 and the other just turned 18. Question is do the boys have any rights to my sisters home? Even if she has a will and gives the home all to step dad do the boys have any rights to the home they always have known? The step dad is trying to run the 18 year old off. Thank you for any help.

Depends on the state and how the title of the home was held. Can you answer one or both of those questions?

How was the home titled, it if was in both names with right of survival then the home is just the step dads.

If the home was just in the wife name and there was a will, it will depend on how the will was made up.

But yes, there are many ways where the kids would not have a claim to the home

It was in my sisters name and knows she made a will and pretty sure she put it into her husbands name. But thing is after she died now all the step dad want's is what ever money he can get.
