View Full Version : Can I take rights away from the father

My son is two years old, and hasn't heard anything from his birth father in the past year, no phone calls, no birthday or Christmas gifts. I am now with the man I am going to marry and have a new baby (3 months) just want to know if and how I can terminate his rights so I don't have to think about this anymore. I live in North Dakota and his father lives in Texas if that helps. Please help me!

Well what is there to think of, if you have not heard of him in two years ?

Is the new husband to be wanting to adopt ?

You need to speak to a lawyer.

As far as I know, you cannot take away parental rights without the consent of the parent involved, regardless if he is absent or not.

Judy will hopefully weigh in on this with more insight.

You need to get married first. Most states will not grant an adoption to a boyfriend or a fiancé. You need to be married at least a year. Then petition family court for TPR and adoption.
