View Full Version : Verbal agreement with father of 3 never honored

I had a verbal agreement with the father of my 3 children, he has never honored our agreement. It has been about five years and he still will not comply. We have been to court but he has somehow been able to get away with paying from $2.00-$23.00 per month our agreement was for $300.00 per month. He is a business owner, he owns several businesses but I believe only one is in his name. What are my options?

Can you prove he makes more then he is claiming? That's the only way for you to get it raised.

There is no verbal agreements that are enforceable for child support. He owes nothing from that. Only the court ordered support is enforceable.

He will be ordered to pay according to his income that is proved in court. It will up to you and your attorney to prove his income by various means

Thank you for your responses califdadof3 and Fr_Chuck. The only way I could probably prove that he makes more would be to hire a private investigator, probably too expensive. While we were in court he pleaded with me to agree to an out of court arrangement with his attorney present, I did agree and it was noted by the court so they are aware of when and where we made the arrangements but not of how much, will this make any difference? He has told our children about 3 different businesses that he owns, I'm almost positive that they would be in another family members name does this mean that he is untouchable?

If the business runs with a business license like most do then with some footork on your part you can find out who is on it. From there you can make decisions. Also if you were in court less then 2 years ago and you can't prove a financial difference of 15% or more the courts aren't going to want to hear from you. Be aware of that.
