My soon to be x husband had an affair with a 17 year old girl. He was 39. She has a record of psychological problems before their relationship and after. I heard she tried to kill herself after their relationship ended. I am in Ohio and I know the age of consent is 16. Can he get in trouble with the law because of this?

The law in Ohio, as it is currently written, only applies to heterosexual couples. Ohio has laws on the books which make homosexual conduct illegal, regardless of age. However, such laws, as they apply to consenting adults in private settings, have been declared unconstitutional by the Supreme Court. Because of this, it is not clear what Ohios age of consent is. However, if both parties consent, and are above the states age of majority (usually 18), there probably won't be any legal problems.

Like many other states, Ohio makes certain allowances in its age of consent law. If both parties are below the age of consent, and are close to the same age, they can sometimes legally consent to have sex with each other. As a general matter, anyone between the ages of 13 and 16 can consent to have sex with someone who is under 18."

As was said at the site quoted by Judy KT, the age of consent is 16. So he couldn't get in trouble for statutory rape. However he could possibly still be charged with other offenses, contributing to the delinquency of a minor, or something like that.
