I live in Charlotte, NC.

As of yesterday (Friday, Oct. 30th), I signed a lease agreement at an apartment complex to move in on Nov. 02nd (Monday) or Nov. 03rd (Tuesday). The reason that I cannot move in is because the first of November happens to fall on a Sunday and the leasing office there will of course be closed. Due to the fact that I am choosing to move out of my current situation, I do not feel that it is necessary to go ahead and pay for another month's rent, as I will not be here. I have not ever had any type of a written lease since I have been at my current residence, as it has always remained to be pretty much a good faith thing. So on this note, if my landlord decided that he wanted to try and retaliate against me for choosing to move out, even though it is unfeasible for me to do so until the 2nd or 3rd of November, can he require me to vacate these premises immediately without notice because of the lack of any lease agreement, or is he indeed bound by state law to have to go through a process before doing so? I know that the 2nd and 3rd are really only two or three days from now, but your answers would still help and would definitely be appreciated...Just in case I did end up needing them, which could very really always be a possibility.

he can not just evict you, he would have to take you to court.
But at this rate what he can do is sue you for the rent for the month of Oct if you stay past the notice you gave.

Iwould assume you gave them a 30 day notce on Oct 1 that you would be moving.

If you had not give a 30 day notice you will owe the rent for Nov anyway unless they agree not to.
