Me and my husband leaves in Fl and his child leaves in NC with the mom. The mom is currently in the military. She left for tour in Cuba for at least six to nine months without notifing him. She was required by the courts to inform him within six weeks prior to leaving for any time periods six months or more. He now wants to get his child. She is always leaving the child with her mom. She keeps the 11 up all hours of night and around young military men. She has not displayed actions of a fit mom. His concerns is now the mother is out of the country for how long we don't know. what can we do....helpl..

If she is in violation of a Court Order he needs to go back to Court and request that she be held in contempt - at that time he can petition for custody. He will, of course, have to prove that she is unfit or unsafe to parent a child.

I guess the one question is how does he KNOW that she is there for more than six months, ( has he gotten a copy of the orders)

But if he has proof she is out for over six months ( you said she was required to notify) but if she is gone for more than six months does that give him temp custody ???
